An Indian woman who was raped by an Uber driver sued the ride-hailing company on Thursday, alleging that Uber executives had “violated her a second time” when they obtained her medical records and used them to cast doubt on her credibility. The woman, a resident of Texas who is bringing the case as a Jane Doe, filed suit against the company, CEO Travis Kalanick, and former executives Eric Alexander and Emil Michael for violating her privacy and defaming her character. The case stems from a 2014 rape that caused widespread outrage against Uber in India and led to the service being temporarily banned in Delhi. The victim was an Uber passenger who was assaulted by her driver. The driver, Shiv Kumar Yadav, was convicted of rape and sentenced to life in prison. The National Labor Relations Board released a memo saying Uber drivers are independent contractors, not employees. Drivers and activists dispute the classification, arguing they aren't afforded the freedoms that contractors have. The memo was released after Uber's disappointing initial public offering last week. The National Labor Relations Board on Tuesday made public its opinion that Uber drivers should be classified as independent contractors versus full-time employees who are eligible for benefits and other protections. Labor activists called it a "bogus" decision that does not reflect the true nature of drivers' obligations to the ride-hail giant, which went public last week. Uber has been accused by police of allowing a driver who sexually assaulted a passenger to strike again by not reporting the attack, along with other serious crimes. In a strongly worded letter, Insp Neil Billany of the Metropolitan police’s taxi and private hire team suggested the company was putting concerns for its reputation over public safety. He cited the case of a man who worked for Uber being allowed to stay on the books despite an allegation of sexual assault, leading to another, “more serious” attack on a woman in his car. “Had Uber notified police after the first offence, it would be right to assume that the second would have been prevented,” the inspector wrote in his letter to Helen Chapman, head of taxis and private hire at Transport for London (TfL). KOLKATA: A city-based model was allegedly dragged out of an Uber cab and molested by a group of men in south Kolkata in the early hours of Tuesday. The Uber driver was also assaulted by the miscreants. The woman, who works “with the Media and Entertainment industry”, was coming back from work with a colleague when the car was allegedly attacked by a group of 15 bike-borne men near Exide Crossing. The men dragged out the driver and beat him up. The victim ran across to nearby Maidan Police station across the road, requesting an officer to help. The officer initially refused to act stating that the incident comes under the jurisdiction of a different police station, but later decided to help. The Information Commissioner's Office has fined Uber £385,000 over failing to protect its user data. Around 2.7 million UK customers had private information stolen by hackers in the attack. The ICO says that Uber suffered a series of "avoidable data security flaws" which exposed customer data to be accessed and downloaded from Uber's cloud-based storage. The data included full names, email addresses and phone numbers. The attack worked by attacking Uber's website. Using previously-compromised username and password pairs the hackers flooded the site until they found matches. The hackers were then able to access Uber's data storage, where they downloaded the data. Hacks like this are a reminder to use different passwords for every site you use, but ultimately until literally everyone does that this sort of attack will be viable.
